Update 1-voyager gets initial approval for $1 bln binance deal amid national security concerns.

Jan 10 (Reuters) - Bankrupt crypto lender Voyager Digital received initial court approval on Tuesday for a proposed $1 billion sale of its assets to Binance.US, and said it will seek to expedite a U.S. national security review of the deal.

U.S. Bankruptcy Judge Michael Wiles in New York allowed Voyager to enter into an asset purchase agreement with Binance.US and to solicit creditor votes on the sale, which will not become final until a future court hearing.

Voyager attorney Joshua Sussberg said during Tuesday's court hearing that Voyager was responding to concerns raised over the holidays by the U.S. Committee on Foreign Investment in the United States (CFIUS), an interagency body that vets foreign investments into U.S. companies for national security risks. He said Voyager intends to address any issues that would lead CFIUS to oppose the transaction.

"We are coordinating with Binance and their attorneys to not only deal with that inquiry, but to voluntarily submit an application to move this process along," Sussberg said.

CFIUS said in a Dec. 30 court filing that its review "could affect the ability of the parties to complete the transactions, the timing of completion, or relevant terms."

The Binance transaction includes a $20 million cash payment and an agreement to transfer Voyager's customers to Binance.US's crypto exchange, Sussberg said. Customers would then be able to make withdrawals for the first time since July.

Voyager estimates the sale will allow customers to recover 51% of the value of their deposits at the time of Voyager's bankruptcy filing.

If CFIUS blocks the transaction, Voyager will be forced to repay customers with the crypto it has on hand, resulting in a lower payout for Voyager users, Sussberg said.

Washington has increasingly used CFIUS to stymie Chinese investment in the United States.

Binance is owned by Changpeng Zhao, a Chinese-born Canadian citizen, and has no permanent headquarters. The company has been the subject of a money laundering probe by U.S. prosecutors. Binance.US, based in Palo Alto, California, has said that its separate American exchange is "fully independent" of the main Binance platform.

In addition to CFIUS, Voyager's proposed sale was also opposed by the U.S. Securities Exchange Commission and state securities regulators. Glenn allowed Voyager to proceed despite those objections, saying that the securities regulators will be allowed to object to final approval of the sale in the future.

Voyager filed for bankruptcy in July, months after the crash of major crypto tokens TerraUSD and Luna sent shockwaves across the digital asset industry.

Voyager initially planned to sell its assets to FTX Trading, but that deal imploded when FTX went bankrupt in November amid a frenzy of customer withdrawals and fraud allegations that led to the arrest of founder Sam Bankman-Fried. The small staff, led by Aaron Barnard, delivers Aussie hospitality to commuters and perch-sitters alike, all while bopping along to the newest Kaytranada and Little Dragon tracks and chatting about Carl Sagan.

PRACTICAL STUFF: Skip the maze-like route through the office building, and enter the subway station from the street entrance on John Street near William Street. Descend the stairs, pass by the newsstand hawking lotto tickets, and you'll find Voyager on your right. Voyager is open Monday to Friday from 7:30 a.m. to 5 p.m.

The New York City Police Department has spent millions buying products from a tech company that claims it can use social media to track and even predict crimes, a new report reveals.

The Surveillance Technology Oversight Project , a nonprofit dedicated to combating mass surveillance and protecting privacy, has released redacted versions of NYPD contracts with Voyager Labs that show the department signed a contract for more than $8 million with the company in 2018.

Voyager Labs is a tech company that says it produces "AI-based investigation solutions." It sells products across various industries, including law enforcement, the US public sector, and corporate security, according to its website.

While law enforcement's use of social media analytics is nothing new, Voyager Labs says its products are capable of more than surveillance, The Guardian reported . The company has claimed its products can also predict future crime, according to an investigation from the Brennan Center for Justice , a law and public policy institute.

"Voyager Discover takes Voyager Analytics' abilities a step further, analyzing not only who is most influential but also who is most invested in a given stance: emotionally, ideologically, and personally," says a Voyager Labs sales pitch to the Los Angeles Police Department, obtained by the Brennan Center for Justice. "This ability moves the discussion from those who are most engaged online to those most engaged in their hearts."

Voyager Labs has also claimed its AI can assign risk scores to social media users regarding their "ties to or affinity for Islamic fundamentalism or extremism," according to the Brennan Center for Justice report.

Another one of their products — VoyagerCheck — "provides an automated indication of individuals who may pose a risk," according to the Voyager Labs website.

William Colston, vice president for global marketing at Voyager Labs, told Insider the company uses only publicly available data and that their software "is not intended to be a substitute for rigorous human oversight and analysis."

"We categorically reject any notion that our software is designed to infringe upon civil liberties or freedom of speech, or that it is biased in any way," Colston wrote to Insider.

Will Owen, communications director for the Surveillance Technology Oversight Project, called the use of these products "invasive" and "alarming" in a press release .

An NYPD spokesperson told Insider the department uses the software to monitor suspects for a variety of crimes — like gun violence, terrorism, and human trafficking — but clarified that it does not currently use the predictive tools that Voyager Labs offers.

"The Department uses these types of technologies to aid in active investigations and does not use features that would be described as predictive of future criminality," the spokesperson said. 

Meta , the parent company to Facebook and Instagram, sued Voyager Labs in January, claiming that the tech company created thousands of fake accounts to scrape data from more than 600,000 users, The Guardian reported .

Voyager Labs has since filed to dismiss the lawsuit and is awaiting a court decision, according to Colston.

"If Meta is truly committed to protecting its users, and acting in the public interest, then the use of analytical software by those trying to stop malicious actors should be embraced and encouraged," Colston wrote.

Voyager 1, After Major Malfunction, Is Back From the Brink, NASA Says

The farthest man-made object in space had been feared lost forever after a computer problem in November effectively rendered the 46-year-old probe useless.

Several months after a grave computer problem seemed to spell the end for Voyager 1, which for nearly a half century had provided data on the outer planets and the far reaches of the solar system, NASA announced on Thursday that it had restored the spacecraft to working order.

“The spacecraft has resumed gathering information about interstellar space,” NASA said in its announcement about Voyager 1, the farthest man-made object in space.

Since the problem surfaced in November, engineers had been working to diagnose and resolve the issue, a tedious and lengthy process complicated by the fact that it takes almost two days to send and receive information from Voyager 1, which was the first man-made object ever to enter interstellar space and is currently more than 15 billion miles from Earth.

The space community had been holding its breath since last year as the prospect of fixing the aging probe appeared as dire as ever.

In February, Suzanne Dodd, the Voyager mission project manager, said the problem, which hindered Voyager 1’s ability to send coherent engineering and science data back to Earth, was “the most serious issue” the probe had faced since she began leading the mission in 2010.

Voyager 1 and its twin probe, Voyager 2, were launched in 1977 on a mission to explore the outer planets. NASA capitalized on a rare alignment in the solar system that enabled the probes to visit the four outer planets — Jupiter, Saturn, Uranus and Neptune — by using the gravity of each to swing to the next.

Its planetary mission a success, Voyager 1 continued its journey toward the edge of the solar system, and in 1990 it snapped a fabled photo of the Earth — a tiny speck in an infinite darkness that became known as the “pale blue dot.”

In 2012, the probe became the first to cross into interstellar space and had since, along with its twin, which followed six years later, collected data about the heliosphere, the space around the sun directly under the sun’s influence.

Perhaps as profound as the pale blue dot, each spacecraft is equipped with a golden phonograph record loaded with sound recordings and images showing humanity and life on Earth, begging to one day be discovered by another civilization.

The outlook for recovering Voyager 1 improved substantially in April , when NASA reported that it had managed to get the probe to send back “usable” data about its engineering systems and its health. That was followed by news late last month that the team had restored functionality to two of Voyager 1’s science instruments, allowing it to send back science data and continue its mission.

On Thursday, the agency announced that it had brought the remaining instruments back online and restored Voyager 1 to its normal operations.

Still, Voyager 1’s new lease on life may not last very long. NASA has previously estimated that the nuclear-powered generators on Voyager 1 and Voyager 2 were likely to die around 2025. But Voyager 1 has already demonstrated that it can beat the odds. Ms. Dodd hopes both Voyager spacecraft can reach the mission’s 50th anniversary in 2027.
