Rules And Conditions For Visa Subclass 600

Visitor visa subclass 600 rules & conditions.

Each of the six visa streams has specific relevant pre-conditions and post-grant conditions. We shall discuss them in brief. However, applicants have to fulfil the requirements as well.

Tourist Stream – Apply from within Australia

Pre-condition

• The applicant should be a genuine visitor and have adequate funds to support his/her stay in Australia and return to the home country.

Post-Grant Conditions

The department might stipulate the following conditions that one should fulfil.

Condition 8101 – The visa holder does not have any right to work in Australia

Condition 8201 – The visa holder can take up specific courses/training for a maximum of three months.

Condition 8501 – The tourist should have adequate health insurance during their stay in Australia.

Condition 8503 – This condition stipulates that the visa holder cannot overstay the visa under any circumstances.

Condition 8531 – Condition 8531 stipulates that the visa holder should leave Australia before the expiry of the tourist visa.

Condition 8558 – The visa holder cannot stay for a period exceeding 12 months in an 18-month period.

Tourist Stream – Apply from outside Australia

This tourist stream visa is similar to the one discussed above except for the condition that the applicant has to reside outside Australia when applying for the visa and also when the department decides its fate.

Sponsored Family Stream

Pre-conditions

• Your relative who is either a permanent resident or citizen of Australia should sponsor your trip.
• The department might call for a security bond from your sponsor.

Condition 8101 – The visa holder cannot work in Australia.

Condition 8201 – This visa allows you to study or train for a maximum of up to three months.

Condition 8503 – The visa holder cannot overstay the visa.

Condition 8531 – Under any circumstances, the visa holder must leave Australia before the expiry of the visa.

Business Visitor Stream

• You should be a genuine business visitor.
• When applying for this visa, you have to be outside Australia.

Condition 8115 – This condition stipulates that the visa holder does not work in Australia other than engaging in business activities.

Condition 8201 – You can study for a maximum for three months on this visa.

Condition 8303 – This condition stipulates that the visa holder should display excellent character by not indulging in unlawful activities.

Condition 8503 – The visa holder will not get a substantive visa in Australia when they remain in the country.

Approved Destination Status Stream

• The applicant has to be a citizen of PR of China and intend to tour Australia as part of an organized tour by an authorized travel agency.

Post Grant Conditions

Condition 8101 – You cannot work in Australia

Condition 8207 – The visa holder should not undertake any studies or courses in Australia.

Condition 8503 – The visa holder cannot overstay the visa

Condition 8530 – The organized tour should not have any deviation from the one approved by the Ministry.

Frequent Traveler Stream

Pre-Conditions

• Applicant should hold a passport from PR of China
• Provide biometrics with China before application.

Condition 8115 – The visa holder should not work in Australia other than engaging in business activities.

Condition 8201 – You can study for a maximum of three months on this visa

Condition 8503 – There should be no overstaying on this visa.

Condition 8527 – Your health exam report should show that you do not suffer from tuberculosis at the time of entry into Australia.

Condition 8531 – You must exit Australia before the expiry of your visa.

Condition 8550 – The visa holder should intimate any change in contact details at least two days before the change.

Condition 8572 – If the Ministry requests it, you should undergo a medical assessment.

Condition 8573 – Your maximum stay in Australia should not be more than twelve months in any 24-month period.

Australian Borders Opening

Australia will open its international borders in November 2021, The Federal Government will announce the ban on international travel lifted next month which will allow fully vaccinated Australian citizens to return home. Fully vaccinated Australian citizens and permanent residents will be quarantined at home for 7 days, while unvaccinated Australians will still be required to be quarantined at hotels or dedicated facilities for 14 days. The states will gradually open their doors but New South Wales is expected to be the first to welcome international travellers.

• the visa holder or immediate family member of the visa holder is likely to become a burden to the Commonwealth, a State, a Territory or a public authority in Australia;
• cannot leave Australia for reasons beyond the control of the visa holder or immediate family member of the visa holder;
• the visa holder has compelling personal reasons to work in Australia.

Condition 8201 - Maximum 3 months study

Generally, a citizen of a foreign country who wishes to enter the United States must first obtain a visa, either a nonimmigrant visa for a temporary stay, or an immigrant visa for permanent residence. Visitor visas are nonimmigrant visas for persons who want to enter the United States temporarily for business (visa category B-1), for tourism (visa category B-2), or for a combination of both purposes (B-1/B-2).

Here are some examples of activities permitted with a visitor visa:

Business (B-1)

• Consult with business associates
• Attend a scientific, educational, professional, or business convention or conference
• Settle an estate
• Negotiate a contract

Tourism (B-2)

• Vacation (holiday)
• Visit with friends or relatives
• Medical treatment
• Participation in social events hosted by fraternal, social, or service organizations
• Participation by amateurs in musical, sports, or similar events or contests, if not being paid for participating
• Enrollment in a short recreational course of study, not for credit toward a degree (for example, a two-day cooking class while on vacation)

Travel Purposes Not Permitted On Visitor Visas

These are some examples of activities that require different categories of visas and cannot be done while on a visitor visa:

• Paid performances, or any professional performance before a paying audience
• Arrival as a crewmember on a ship or aircraft
• Work as foreign press, in radio, film, print journalism, or other information media
• Permanent residence in the United States

Visitor visas will also not be issued for birth tourism (travel for the primary purpose of giving birth in the United States to obtain U.S. citizenship for their child).

How to Apply

There are several steps to apply for a visa. The order of these steps and how you complete them may vary by U.S. Embassy or Consulate. Please consult the instructions on the  U.S. Embassy or Consulate website .

Complete the Online Visa Application

• Online Nonimmigrant Visa Application, Form DS-160 – Learn more about completing the DS-160 . You must: 1) complete the online visa application and 2) print the application form confirmation page to bring to your interview.
• Photo – You will upload your photo while completing the online Form DS-160. Your photo must be in the format explained in the Photograph Requirements .

Schedule an Interview

Interviews are generally required for visa applicants with certain limited exceptions below. Consular officers may require an interview of any visa applicant.

You should schedule an appointment for your visa interview at the  U.S. Embassy or Consulate  in the country where you live. You may schedule your interview at another U.S. Embassy or Consulate, but be aware that it may be more difficult to qualify for a visa outside of the country where you live. 

Wait times for interview appointments vary by location, season, and visa category, so you should apply for your visa early. Review the interview wait time for the location where you will apply:

Applicants scheduling visa appointments in a location different from their place of residence should check post websites for nonresident wait times.

• Fees - Pay the non-refundable visa application fee , if you are required to pay it before your interview. If your visa is approved, you may also need to pay a visa issuance fee, if applicable to your nationality. Fee information is provided below:

Gather Required Documentation

Gather and prepare the following required documents before your visa interview:

• Passport valid for travel to the United States – Your passport must be valid for at least six months beyond your period of stay in the United States (unless exempt by country-specific agreements ). Each individual who needs a visa must submit a separate application, including any family members listed in your passport.
• Nonimmigrant Visa Application, Form DS-160 confirmation page.
• Application fee payment receipt, if you are required to pay before your interview.
• Photo – You will upload your photo while completing the online Form DS-160. If the photo upload fails, you must bring one printed photo in the format explained in the Photograph Requirements .

Additional Documentation May Be Required

Review the instructions for how to apply for a visa on the website of the U.S. Embassy or Consulate where you will apply. Additional documents may be requested to establish if you are qualified. For example, additional requested documents may include evidence of:

• The purpose of your trip,
• Your intent to depart the United States after your trip, and/or
• Your ability to pay all costs of the trip.   

Evidence of your employment and/or your family ties may be sufficient to show the purpose of your trip and your intent to return to your home country. If you cannot cover all the costs for your trip, you may show evidence that another person will cover some or all costs for your trip.

Note:  Visa applicants must qualify on the basis of the applicant's residence and ties abroad, rather than assurances from U.S. family and friends. A letter of invitation or Affidavit of Support is not needed to apply for a visitor visa. If you choose to bring a letter of invitation or Affidavit of Support to your interview, please remember it is not one of the factors used in determining whether to issue or deny the visa.

Attend Your Visa Interview

A consular officer will interview you to determine whether you are qualified to receive a visitor visa. You must establish that you meet the requirements under U.S. law to receive a visa.   Ink-free, digital fingerprint scans are taken as part of the application process. They are usually taken during your interview, but this varies based on location.

After your visa interview, the consular officer may determine that your application requires further  administrative processing .  The consular officer will inform you if this required.

After the visa is approved, you may need to pay a visa issuance fee (if applicable to your nationality), and make arrangements for the return of the passport and visa to you.  Review the  visa processing times  to learn more.

Entering the United States

A visa allows a foreign citizen to travel to a U.S. port-of-entry (generally an airport) and request permission to enter the United States. A visa does not guarantee entry into the United States. The Department of Homeland Security (DHS), U.S. Customs and Border Protection (CBP) officials at the port-of-entry have authority to permit or deny admission to the United States. If you are allowed to enter the United States, the CBP official will provide an admission stamp or a paper Form I-94, Arrival/Departure Record. Learn more about admissions and entry requirements, restrictions about bringing food, agricultural products, and other restricted/prohibited goods, and more by reviewing the CBP website .

Extending Your Stay

See  Extend Your Stay  on the U.S. Citizenship and Immigration Services (USCIS) website to learn about requesting to extend your stay beyond the date indicated on your admission stamp or paper Form I-94. 

Failure to depart the United States on time will result in being  out of status . Under U.S. law, visas of individuals who are out of status are automatically voided ( Section 222(g) of the Immigration and Nationality Act ).  Any multiple entry visa that was voided due to being out of status will not be valid for future entries into the United States.

Change of Status

If your plans change while in the United States (for example, you marry a U.S. citizen or receive an offer of employment), you may be able to request a change in your nonimmigrant status to another category through U.S. Citizenship and Immigration Services (USCIS). While you are in the United States, receiving a change of status from USCIS does not require you to apply for a new visa.  However, once you depart the United States you must apply for a new visa at a U.S. Embassy or Consulate in the appropriate category for your travel.

Additional Information

• An individual on a visitor visa (B1/B2) is not permitted to accept employment or work in the United States.
• There is no guarantee you will be issued a visa. Do not make final travel plans or buy tickets until you have a visa.
• A valid U.S. visa in an expired passport is still valid. Unless canceled or revoked, a visa is valid until its expiration date. If you have a valid visa in your expired passport, do not remove it from your expired passport. You may use your valid visa in your expired passport along with a new valid passport for travel and admission to the United States. 

Travel for Medical Treatment

If you are seeking medical treatment in the United States, the consular officer may ask for further documents at your visa interview, which may include:

• Medical diagnosis from a local physician, explaining the nature of the ailment and the reason you need treatment in the United States.
• Letter from a physician or medical facility in the United States, stating they are willing to treat your specific ailment and detailing the projected length and cost of treatment (including doctors’ fees, hospitalization fees, and all medical-related expenses).
• Proof that your transportation, medical, and living expenses in the United States will be paid. This may be in the form of bank or other statements of income/savings or certified copies of income tax returns (either yours or the person or organization paying for your treatment).

Visitor Visas for Personal or Domestic Employees (B-1)

You may apply for a B-1 visitor visa to work in the United States as a personal or domestic employee for your employer in limited situations. You may work in the United States on a visitor visa if your employer is:

• A U.S. citizen who has a permanent home or is stationed in a foreign country, but is visiting or is assigned to the United States temporarily; or
• A foreign citizen who is in the United States on one of the following nonimmigrant visa categories:  B, E, F, H, I, J, L, M, O, P, or Q.

Visa Renewal

Whether you are applying for the first time or renewing your visa, you will use the same application process (please review How to Apply , above). Some applicants seeking to renew their visas in certain visa classes may be eligible for the Interview Waiver (IW) which allows qualified individuals to apply for visa renewals without being interviewed in person by a U.S. consular officer. Review the instructions on the website of the U.S. Embassy or Consulate where you will apply to determine if the IW is available and if you qualify.

Do I need a visa if I have an ABTC?

Yes, you will still need a visa to travel to the United States, unless you qualify for the  Visa Waiver Program . Having an Asian-Pacific Economic Cooperation (APEC) Business Travelers Card (ABTC) does not change visa requirements, your visa status, or the visa process for travel to the United States.

How can I use my ABTC when I apply for my visa?

If you have an Asian-Pacific Economic Cooperation (APEC) Business Travelers Card (ABTC),  you might be able to schedule an expedited visa interview appointment. Review the instructions for scheduling expedited appointments on the website of the  embassy or consulate  where you will apply. 

Visa Annotations for Certain Maritime Industry Workers

Certain foreign maritime workers are eligible to apply for a Transportation Worker Identification Credential (TWIC) once in the U.S. If you, as a maritime industry worker, will perform services in secure port areas, your visa must be annotated “TWIC Letter Received.” Workers whose visas are not annotated will not be permitted by the Transportation Security Administration (TSA) to apply for a TWIC.

In order for your visa to be annotated, you must obtain a letter from your employer explaining the need for a TWIC and that you are a potential TWIC applicant. See a template example of this letter. You must present this letter when you apply for the B-1 visa. You must meet all other eligibility requirements for a B-1 visa.

Misrepresentation or Fraud

Attempting to obtain a visa by the willful misrepresentation of a material fact, or fraud, may result in the permanent refusal of a visa or denial of entry into the United States.

Citizens of China

In accordance with the agreement signed between the United States and China to extend visa validity, beginning on November 29, 2016, Chinese citizens with 10-year B1, B2 or B1/B2 visas in Peoples’ Republic of China passports will be required to update their biographical and other information from their visa application via a website every two years, or upon getting a new passport or B1, B2, or B1/B2 visa, whichever occurs first.  This mechanism is called EVUS - Electronic Visa Update System.

The EVUS website is now open to the public for enrollments at www.EVUS.gov .  CBP will not collect a fee for EVUS enrollment at this time. CBP anticipates the eventual implementation of an EVUS enrollment fee, but does not have a time frame. Until the implementation of a fee, travelers can enroll in EVUS without charge.  The Department of Homeland Security, Customs and Border Protection (CBP) will keep visa holders informed of new information throughout the year. Visitor Tourist visa 600 Australia

This article will help you understand different types of Visitor visas including basic legal requirements, policy and procedures that apply to the Subclass 600 (Visitor) visa to Australia.

There are three visitor visa subclasses available for applicants intending to visit Australia.

• the Subclass 600 visa,
• Subclass 601 (Electronic Travel Authority) visa (the Subclass 601 visa),
• Subclass 651 (eVisitor) visa.

This article focusses on the Subclass 600 visa only.

The objectives of the Subclass 600 visa are to:

• facilitate the entry of genuine tourists, business and family visitors;

Subclass 600 Visa Streams

The Subclass 600 visa is comprised of five distinct streams:

• the Tourist stream;
• the Sponsored Family stream;
• the Business Visitor stream;
• the Approved Destination Status (ADS) stream; and
• the Frequent Traveller stream.

It is important to understand and apply the relevant law as set out in the  Migration Act 1958  (the Act) and the  Migration Regulations 1994  (the Regulations) to be successful. Many of the requirements in the Act are expressed in objective terms and do not allow any discretion for officers in decision making. To the extent that the Act and Regulations allow for discretion, the Department must consider its approved policy and procedures where relevant however, policy and procedures do not have the force of law.

Applicants are required to identify and apply for the stream of the Subclass 600 visa that is appropriate for the purpose of their visit to Australia. The Subclass 600 application is taken only to be an application for the stream the applicant has identified and will only be assessed against the criteria for the stream the applicant has applied for.

Schedule 1 visa application validity requirements as per MIGRATION REGULATIONS 1994

Item 1236 of Schedule 1 outlines the requirements for making a valid Subclass 600 visa application. Each applicant must make a visa application in their own right.

Fee for priority consideration

Regulation 2.12M provides a priority consideration service on request (priority service or ‘fast track’) for applications for a Subclass 600 visa in the Tourist stream or Business Visitor stream lodged by certain passport holders specified in a legislative instrument made under subregulation 2.12M(7), refer to  Migration (Priority consideration for certain visitor (Class FA) visa Applications) Instrument (LIN 21/074) 2021 . The priority service may be requested by a Subclass 600 visa applicant for a fee that is in addition to the VAC.

Foreign government representatives

Foreign government representatives   seeking to travel to Australia on a short term basis may apply for a   Subclass 600 visa in the Business Visitor stream with a nil VAC.

Applicants accompanying guests of Government

A guest of Government, as defined in regulation 1.03 of Part 1 of the Regulations, means an official guest of the Australian government, or a member of the immediate family of the official guest who is accompanying the official guest.

Emergency situations and special events

In limited emergency situations and special events, a legislative instrument will be issued by the Minister under subparagraph 1236(2)(a)(iv) to allow for a nil VAC for eligible applicants.

Pacific-Australia Card (PAC) holders

The Pacific-Australia Card (PAC) is a travel facilitation measure designed to streamline travel to Australia for Pacific leaders from a range of fields, including politics, government, business, church, sport and academia. PAC holders applying for a Subclass 600 visa are not eligible for a nil VAC unless they meet subparagraph 1236(2)(a)(iii) or 1236(2)(a)(iv).

Schedule 2 Visa Criteria

Subdivision 600.21 provides the common criteria that must be satisfied by all Subclass 600 visa applicants.  In summary, these criteria relate to:

• a genuine intention to stay temporarily in Australia (refer to clause 600.211);
• adequate means of support (refer to clause 600.212);
• public interest criteria (PIC) (refer to clause 600.213);
• special return criteria (SRC) (refer to clause 600.214); and
• the total period of stay must not exceed 12 consecutive months unless exceptional circumstances exist for the grant of the visa (refer to clause 600.215).

Genuine intention to stay temporarily in Australia – clause 600.211

Clause 600.211 requires that an applicant genuinely intends to stay temporarily in Australia for the purpose for which the Subclass 600 visa is granted. To determine whether an applicant has a genuine intention to stay temporarily in Australia, a decision maker must consider number of things, which we will discuss and assess in a consultation.

The purpose of clause 600.211 is to protect the integrity of the visitor program by ensuring that decision makers identify, manage and monitor the level of risk of an applicant.

Controversial visitors

Subclass 600 visa applicants who are considered to be controversial visitors will be  be referred to a special  Unit () for additional assessment against PIC 4001 (Character), PIC 4003(a) (foreign policy interests) and PIC 4003(c) (autonomous travel sanctions) (in consultation with the Department of Foreign Affairs).

Applicants intending to undertake medical treatment or visit a hospital or health care facility in Australia

The Subclass 602 visa is the appropriate visa option for applicants intending to undertake medical treatment while in Australia.

Sponsorship requirements

Under clause 600.232, Sponsored Family stream applicants must be sponsored by an approved individual or organisation.

Individual sponsors

Under subclause 600.232(2), if an applicant is sponsored by an individual, the sponsor must be:

• at least 18 years of age, and
• a ‘settled’ Australian citizen or settled Australian permanent resident.
• The sponsor is a relative [defined in regulation 1.03 ] of the applicant – paragraph 232(2)(a)

Sponsorship limitations – Regulation 1.20L

• The sponsorship bar Subregulation 1.20L(4) provides the prescribed circumstances to lift a 5 year bar where the sponsor’s previously sponsored Subclass 600 visa holder did not comply with condition 8531.
• The security bond Clause 600.235 (and 600.225 for applications in the Tourist stream) enables decision makers with section 269 delegation the discretion to request a security bond.
• Forfeiture of the security bond If a sponsored visa holder does not comply with their visa conditions, the security bond is liable for forfeiture.

Parents of Australian citizens or permanent residents

Parents of Australian citizens or permanent residents intending to visit family in Australia for shorter periods than provided on a Subclass 870 Sponsored Parent (Temporary) visa, are able to apply for a Subclass 600 visa

Non-Standard Visitor Activities

Subclass 600 visa applicants are able to travel to Australia for a range of short term non-work purposes or activities provided they do not breach conditions 8101 or 8115.

The Visitor (Subclass 600) visa is the Australian tourist visa, being a temporary visa permitting the holder to travel to Australia as a tourist, to see family and friends, or to undertake a “business visitor activity”.

Ordinarily it is valid for 12 months from the date of grant to enable the holder to travel to Australia, and stay for up to 3 months per entry. If it is granted with a multi-entry facility, this would allow the person to enter Australia multiple times during the visa validity.

Citizens of certain countries have access to “streamlined” versions of this visa such as the eVisitor and the Electronic Travel Authority ( ETA ). Further discussion on these visas can be found here.

What is the Visitor (Subclass 600) visa and its streams?

The Visitor (Subclass 600) visa has various streams, including:

• Tourist stream;
• Business Visitor stream;
• Sponsored Family stream;
• Approved Destination Status stream; and
• Frequent traveller stream.

This article outlines the eligibility criteria to apply for the Visitor (Subclass 600) visa under the “tourist” stream.

For completeness, the last two streams only apply to citizens of China, the “sponsored family” stream applies to those who have Australian family members that are willing to ‘sponsor’ them, and we have an article about the Business Visitor stream here .

Eligibility for Visitor (Subclass 600) visa

Generally speaking, to be eligible to apply for a Visitor (Subclass 600) visa, you must:

• Intend to visit Australia or remain in Australia to visit an Australian citizen or permanent resident (partner, spouse, de facto partner, child, sibling), or for any other purpose that is not related to business or medical treatment;
• genuinely intend to stay temporarily in Australia for which the purpose is granted (“genuine temporary entrant” criteria);
• have adequate means (or access to adequate means) to support yourself during the period of your intended stay in Australia; and
• satisfy identity, health, and character criteria.

If you’re visiting some family members, the Department may require you to be sponsored and/or lodge a bond (which would be forfeited if you don’t leave the country).

What do you normally need to provide?

In addition to standard identity documents, you would generally want to provide documents to evidence that you satisfy the “genuine temporary entrant” criteria. This may include evidence of your:

• employment;
• business ownership (and turnover);
• assets (property, business, vehicles, bank accounts etc.);
• international travel (particularly to other “developed” countries);
• study, familial and/or other commitments in your home country; and
• activities in Australia (travel itinerary, letter of support from friends/businesses, accommodation/flights etc.).

The above is always dependent on your circumstances, and you may need to provide more or less of the above documents.

For example, if you’re the parent of an Australian citizen child – you may wish to provide evidence that your child is an Australian citizen, evidence of your familial relationship (such as a birth certificate), and that you’re intending to visit them and stay with them.

What happens after the visa is granted?

Once the Visitor (Subclass 600) visa is granted, there are two things you need to be aware of:

• the validity period, stay period, and entry-facilities of the visa; and
• the conditions applicable to the visa.

The Visitor (Subclass 600) visa is ordinarily valid for 12 months from the date of grant, permits the holder to stay in Australia for up to 3 months from the date of entry, and has multi-entry facilities. The Department can grant this with single entry facility, and/or for a lower duration of time / stay period.

In certain limited circumstances, it is possible to request for flexibility to this and request amendments to this. For example, parents of Australian Citizens with various compliant travel to Australia, could potentially receive a Visitor (Subclass 600) visa valid for 3 years, with a 12 month stay period per entry. It is discretionary on the Department and also depends on your circumstances.

On approval, the Visitor (Subclass 600) visa will be subject to conditions requiring the holder:

• not engage in work in Australia (condition 8101); and
• not engage in any studies or training for more than 3 months (condition 8201).

There are also some discretionary conditions that may be imposed, including condition:

• 8501 – to maintain adequate arrangements for health insurance while in Australia (see here );
• 8503 – where after entering Australia, the holder will not be entitled to be granted a substantive visa (other than a protection visa) while the holder remains in Australia; and
• 8558 – to not stay in Australia for more than 12 months in any period of 18 months.

How much does it cost?

The lodgement fees for the offshore Visitor (Subclass 600) visa is AUD $150.

Each person must apply for the Visitor (Subclass 600) visa separately, so the above fee applies per application. For example, a family of four comprising of two adults and two children would need to pay AUD $600 for the whole family.

How long are the processing times?

As at the time of writing, the Department’s stated processing times for Visitor (Subclass 600) visas under the “tourism” stream are such that:

• 25% are finalised in 16 days;
• 50% are finalised in 39 days;
• 75% are finalised in 63 days; and
• 90% are finalised in 4 months.

This captures the time from the date of lodgment of the Visitor (Subclass 600) visa application to finalisation.

This multi-entry, long-validity coupon is a great way to save money. The duration of a visitor's visa might be up to six years. Each visit to Australia by a visa holder is limited to a maximum of three months.

If your subclass 600 visa is due to expire, you should apply for an Australian Visitor Visa Extension. Depending on your situation, it can grant you an additional three, six, or twelve months of stay. Only visitors who seek to extend their stay in Australia beyond the original visa's expiration date will be granted this extension.

Requirements for an Australian Tourist visa subclass 600

You must have a valid passport with at least six months' validity from the date of your intended arrival in Australia. You must meet health and character requirements. I am in Australia and my tourist visa is about to expire ?

If you are in Australia and holding a temporary visa and your visa is about to expire. You should apply for a new visa before your current visa expires to maintain your legal stay in the country.

If you are already in Australia, you can consider the following option:

What you can do upon Grant of Australian Tourist Visa Subclass 600

Upon grant of Tourist Visa 600, you can travel to Australia for vocation, to visit a family member or a close friend. Tourist Visa comes with different travel facilities:

You might be able to enter Australia once and then will need to apply for a new tourist visa if you want to return to Australia again. That means your tourist visa is granted for single entry. You might have Multiple-entry travel facilities and can enter Australia as many times as you want and remain in Australia for the specific time mentioned on your tourist Visa Grant Letter.

Visa Conditions on Australian Tourist Visa:

Hi, I would like to ask a question regarding visa conditions and what to do to change them. I haven't found an answer in this regard on the forum and on the internet unfortunately. I am currently residing in Australia as a partner (dependant) of a Student 500 holder (PhD student). So both of us are on Subclass 500-Student visa. My visa has a condition of 8201-Max 3 months study. I also decided to do my PhD and got awarded a PhD scholarship and admission offer from a university in Australia. In this condition, in order to request DOHA to lift my 8201 visa condition, what should I do? Should I proceed with ''notification of changes in circumstances" by filling out this form ( https://immi.homeaffairs.gov.au/form-listing/forms/1022.pdf ), or should I make a new Student Visa-Subclass 500 application as an independent primary applicant? Notification of changes in circumstances should not be applicable here, you either need exemption from 8201 (I am not sure if that's possible), or apply for a new independent visa. I'd go for the latter (new independent visa), but probably a better idea would be to take counsel from your university.

I have the same situation here. Can you update with more information of what was your result? My situation: I entered Australia with PhD Student Visa (Subclass 500 Post Graduate Research Sector) and my spouse is planning to join me on Subsequent Entrant Visa. She wants to get a certificate III in Childcare before working as a Child Care Educator and needed to study at training center for 9 months - 1 year before she could start working.

Does anyone have any updates on this? I'm dependent on my partner's student visa, and he's doing a PhD. I want to take a certificate III course that has 5 months duration, which is just 2 months over the period they allow in the visa. It makes no sense for me to apply for a new student visa for such a short course if I have 3 more years of visa allowance.

Hi> I'm in an similar situation... I'm on a student dependent visa and condition 8201 max 3-month study is not on my visa grant letter, nor on the recent VEVO check I did. Does this mean I can study with no limit? I remember a student dependent visa should have this condition... Is it normal not to have condition 8201 on a student dependent visa? Could this be a mistake the department made?

Visa condition of 8201 states that if the course is not leading for student visa 500 then you can enroll for that course. The statement is mentioned here: Adults continuing with online study at an institution in Australia in other than a registered course (and therefore ineligible for a Subclass 500 visa) are not regarded as engaging in study.

Visitor Visa apply for student with 8201 condition (max 3months study)

Hello everyone, i am new here and had a look on the forum but couldnt find any similar case. I have been granted an E visitor (651) visa with 12 months valability and 3months max stay each entry. My initial plan was to apply for student visa ONSHORE but due to the 8201 condition ( MAX 3 MONTHS STUDY) the plan fall through. Is there any way the 8201 condition can be waived ? I had a look on the IMMI Website and they say than only exceptional cases can apply for a student visa from on shore, does that mean they had the same 8201 condition or is a general rule for student visas to be applyed OFFSHORE. OR Is it possible after my 3 months stay to go off shore apply for Student visa and return to Au on the same Evisitor visa 651? Is that something I could do and if yes do I need to be offshore for the visa to be granted? My brother lives in Au for a couple of years now and he would really appreciate having me there. Any information will be greatly appreciated! Thank you!  

If you are are from a country with Assessment Level 1 you can apply for a student visa onshore. If you are from an an Assessment Level 2 or 3 country you will have to go offshore to apply for a student visa. The the 8201 condition on a tourist visa cannot be waived. The visa you have is for tourism purposes only. Regards

Can I exit, at the end of my 3month stay and apply for Student visa Offshore and return back on the visitor visa which is still valid? Would applying for a student visa offshore chage anything on my Visitor Visa ? Provided i can do so , do I need to be offsore to get the Student visa aproved? Thank you again!  

You can exit at any time and apply for the student visa offshore and return back on the visitor visa if it is still valid. Applying for the student visa will not change anything on your visitor visa. You will need to go offshore again to get you student visa approved. Regards

Australian Tourist Visa Conditions

It is important to understand the Australian tourist visa requirements before you apply. The most common Australian Tourist Visa conditions are:

• Condition 8503 – No Further Stay
• Condition 8501 – Maintain adequate health insurance
• Visa Condition 8201. (1) While in Australia the holder must not engage, for more than 3 months, in any studies or training.
• Condition 8101 – No Work

Condition 8503 – No Further Stay Condition

The Migration Regulation 1994 state:

The holder will not, after entering Australia, be entitled to be granted a substantive visa, other than a protection visa, while the holder remains in Australia.

Essentially this means that if you have this condition on your visitor visa, you will not be able to apply for another visa while you are in Australia (unless you need to apply for protection). If you would like to apply for another Australian visa, you will need to leave the country first and apply while offshore.

Condition 8503 is mandatory for the following Visitor visa (subclass 600) streams:

• Visitor visa (subclass 600) (Sponsored Family stream)
• Visitor visa (subclass 600) (Approved Destination stream)
• Visitor visa (subclass 600) (Tourist stream) if sponsorship has been imposed on it

Visa Condition 8501

“the holder must maintain adequate arrangements for health insurance while the holder is in Australia”.

The Department might ask for evidence of your health insurance before they grant your subclass 600 visa.

Visa Condition 8201. (1)

“While in Australia the holder must not engage, for more than 3 months, in any studies or training.”

This condition is quite straight forward. You can not do any study or training that goes for longer than 3 months while you are on your subclass 600 visa.

Visa Condition 8101 – No Work

You cannot work while you are on the subclass 600 visa. This visa is for tourist purposes only.

If a person does have their visa cancelled as a result of breaching a visa condition, they will be required to leave Australia and may experience significant difficulties with their future applications to visit Australia.
